Whoever does any act with such intention or knowledge, and under such circumstances that, if he by that act caused death, he would be guilty or murder...

these starting lines of 307 tells themselves that the intention of murder must be ther to apply 307.

You have no right to dictate as to under which section the offence should be tried. Relevant section would be applied looking Upon the facts of the case, as to what offence appears to have been committed
