Legal Question in Criminal Law in India
I have issued a cheque for Rs.50,000/- towards the surity as i am one of the gurantors of prized chit amount of my relative and he is fail to pay regular installments to the chit fund company, the chit fund company filed a case u/s 138 against me as i had not paid the said amount in staturatory period, but eventually the amount has been paid one day before getting the summons, through demand draft in favour of chit fund company, is there any chance to sentense me for prision, kindly guide me

Mere payment is not sufficient to lawfully compound the offence.
However, payment can be regarded as a mitigating circumstance having bearing on the quantum of sentence.
