Yes, the court is empowered to summon any person, including a Government servant, under Section 319 of Cr P C ,if the person is found 'prima facie' guilty of the offence.

Section 319 Cr.P.C. provides for adding any person as an accused based on evidence adduced in the Court.

Subject to provisions of section 197 Cr.P.C. and/or any local law in that behalf, a police officer can also be made an accused under section 319 Cr.P.C., if there is sufficient evidence for that purpose.
