Legal Question in Criminal Law in India
One of the lady had lodged private complaint under ipc 354 509 in court. Court directed police under 156\3 . police investigated and sent report w\o any charge and arrest to the court. All the witnesses are in favour of the accused. Complainant did not appear in the court neither her advocate for first 2 years .no summons have been issued.3 years have been lapsed .why court is not dismissing the case?

unless the prosecution leads its evidence, the case cannot be dismissed. however, you may approach the high court for quashing of complaint.
