Two employees are occupying the govt .staff quarters since two years without paying the house rent. .When other employees raised this issue through RTI ACT from the Employer .The employer replied in written that the quarters had been alloted to the employees on their verbal request for temporary occupation and they are not paying any house rent for the same. The question here arises --Whether the employer can use his discretionary powers without charging any money ? who will pay the house rent ? Whether it is misuse of authority ? Whether it is discrimination with other employees? Whether a suit can be filed against the employer for misusing his authority ? whether it will be considered financial irregularity ?What is legal course of action ?

If it is public body, you may represent to the higher authorities and consider a legal action if appropriate remedy is not provided.

If any provision is made under the said Act and by which the Authority is empowered to do like that in such circumstaces no action can be taken against the autority otherwise this action is a gross negligence of performing the responsibility from the part of Authority .And for this he should be prosecuted.

You may have to check whether the companies rules for allotting accomodation permits such kind of occupancy. Only after that a suitable course of action can be decided.
