Has the police lodged the FIR or is the complaint still lying with the Police station PLEASE CLARIFY THIS AT THE OUTSET. In case the police has not lodged an FIR, then you have to move the court of the concerned magistrate u/s 200 CrPC alongwith an application u/s 156(3).
