Legal Question in Criminal Law in India
Marriage broken up just before Saptpadi or say Phere ceremony, As bride member alleged us with a fake dowry case.
This case is registered under FIR no. 20110123 Dtd. 12/05/2011, I too completed one Judicial Custody in tihar jail & release on 26/05/2011.
Previous case is registered on Karkardooma Court and now it is on Mahilla court of karkardooma. But still no date is confirmed to us. We discuss the same with concerned IO but he don't give satisfactorily reply.
Also, We refund each & every belonging of bride party but till date no belonging of our's is submitted by bride party. They thrashed us too badly & snatched our valuable belonging's from us in police station itself. For this no action is taken by any police official's till date.
So first we need back our each & every belonging's as it is consisting mainly of valuable jewellery roughly value of 10.0 lakh. But they refused to give us back.
Kindly suggest us a best solution to proceed further and get our belonging's back to us.

saptapadi did not complete means the marriage did not take place. She is not your wife. She has not lived with you. the gifts or things they took from you, forcibly or not, have to be returned back to you. You may lodge a formal complaint with the police. if police does not take the required action, you may file an application under 156(3) cr pc with the magistrate seeking direction against SHO for registration of Fir. Another option is to file the criminal complaint under section 200 cr pc incorporating all the allegations including return of your goods.
