Legal Question in Criminal Law in India

I got married in 2007 and myself and wife stayed for only 2 months together. After that we have not seen each other but talked a couple of times last year.

My wife filed a divorce case in Family court in India. The case is still on and maintaienance is yet not decided.

In the meanwhile the girl served a notice for returning articles jwellery etc increasing the number falsely. My lawyer replied once the current running case is decided the articles will be returned.

Meanwhile she did serve me summons under Sec 406 with a date of 1 month after today against myself.

The police officer came and gave away the slip back at my home in India.

Court has issued summons u/s 406 against me in matrimonial case. What should I do before the date?I am not in india? Can I deal with it without going to India?

yes, you can deal with the situation even if you are not in india. you need to send a duly notarized attorney in favour of your lawyer and he would file an application for anticipatory bail on your behalf. once the bail is granted, u/s 498a/406, you would be able to fight the case out without the fear of being arrested.
