Legal Question in Criminal Law in India
I had given one month rent as advance before getting the premises for which no receipt was given Premises was given after 21 days from the scheduled date He asked for two months advance against which I gave him a cheque on 15 Aug On 16 Aug he told to vacate the premises therefore a stop payment was made for the cheque now the Landlord has filed a case 138 against me for cheque stop payment He has not even signed rent agreement & claiming that I have not given him single peny & stayed in house Is Stop payment made due to dispute a criminal offence What will be out come of my case

have you sent a reply to the mandatory notice sent by the landlord ? You should explain in detail in your reply about your tenancy etc. What you have stated in your message is true then you will be acquited.
