Legal Question in Criminal Law in India
my mother has filed a false crpc125 against my father who is 70 years of age.suffering from multiple heart disease.lower court has ordered interim maintanence of rupees 4000 p.m.from the date of filling case.two of my brothers are earing very well.third brother is having cerebral palasy.they have throw out my father from his own house.also filed injunction case against him so that he cant sell his only property in which my brothers mother and brothers wife is staying.pls advice what to do.my father is penyless .

Immediately move to tribunal established for maintenance of parents and senior citizens to claim maintenance from the sons for father.

First, no injunction can be granted against the true owner. If father himself is penniless or depends upon others how can he pay main to his wife. She may claim main u/s 125 itself from sons who are earning. Need to look into papers for further opinion.
Your father should engage a lawyer and the lawyer would guide and help him in his difficult time.
