Procedure under Criminal Procedure Code: If police are not taking action than write a letter to Superintendent/Commissioner of Police and post it thru Registered Post Acknowledgment due. If still action is not taken on your complaint you can file complaint in the court.

You will a petition u/s 156(3) of CRPC before the court. Do it through a lawyer.

Court will order the police to investigate the matter under Sec 202 of CrPc and ask them to submit the report. After receiving report and on the basis of your lawyer's argument the court decides whether to continue with the matter or not. If the court decides to continue it has discretion to treat the same as pvt criminal complaint or order the police to lodge FIR and file the case.
