Negotiable Instruments Act
a proprietorship company has returned my few chqs but before filing the case same has been lost during travelling I have lost my cheques which are returned ... how can i file case under Negotiable Instruments Act pl suggest

Dont you have the photocopies of the same. But anyways you can serve legal notice stating the facts that the cheques have been lost.
Its not a big issue!

in case you have lost your cheques, it would be difficult for you to prove your case. better file a suit for recovery.

Seek permission of court to adduce secondary evidence.

A case under N.I.Act may not be maintainable in the absence of original cheques.
However, you may consider filing a civil suit for recovery of money.

Unfortunately, you will require original cheques to file the complaint. However, if you have copies you may request the court to lead secondary evidence.
