Legal Question in Criminal Law in India

If both parties have agreed for mutual divorce. The girl after taking first installment of mutal divorce backs out and does not take her criminal cases back what action Can I take against her. She has agreed to pay double amount if she backs out and if she does not return her brother will pay the amount. What case can I file against her if she backs out. Will her back out will help me to get the criminal cases get queashed
