Legal Question in Criminal Law in India
If a party, who has been accused & is on the verge of being convicted u/s 138 of NIA and also has been proved beyond doubt & charge sheet filed u/s 420/ 120B, files a false application with concocted stories & fake documents u/s 156(3) against the original aggrieved & complainant, is the magistrate obliged to hear the original complainant's side before deciding, or he just passes his order?
