once the pasport is seeized by court on dvc of2 act how can he get the passport through court if the case is still in pending

By moving an application to the court and giving a cogent reason to have the passport back.

Court will not easily release your passport if the case is pending.
But you can get your passport only for special reason for specific time. Rest consult your lawyer, after going through your case, he will guide you properly.

apply to the court by giving some good reason so that the court will order to handover the passport back to you.
