Passport seize

W.A has been issued against an NRI working abroad on work permit in 498a case. He is not coming to India so no investigation has been started and even he has not been arrested as he lives abroad.He will not come back.

Is it possible to seize his passport when he is still abroad?

The investigation may not be stopped in the absence of the main accused.

On an application from the IO/Police, the authorities may cancel his passport after giving a show cause notice. If the passport is cancelled, his stay in the foreign country may become illegal.

The police may possibly arrest his parents/ siblings on the charge of conspiracy (120-B IPC) if sufficient grounds may be existing against them.

Yes, through the passport department. However, you can also consider proclaiming him an absconder in consultation with your local advocate.
