Legal Question in Criminal Law in India
Can a person convicted under any non bailable sections of forgery and cheating ask the lower court time for appeal before being taken in custody or after going in custody he has to apply for bail?

If he has been sentenced for upto three years the trial court can suspend the sentence and he may go for applea. If he has been convicted for the offence more than three years only applelate court can grant bail. Take the example of Navjot Sigh Sidhu case.
