if a person dosent file income tax and files case of 138 against a person .can he be liable to win the case

there is no relationship between income tax filing; and a case u/s 138 of N.I.Act.

There is a case law of Bombay High Court holding unaccounted money advanced as not legally enforceable debt and therefore 138 NI not attracted.
