some person filed the case 420 but before that they had filed he 138 only.
also police did not summmit hte chargesheet in court still today

in case the offense of cheating was committed after the complaint of 138 then there is no ground of illegality but if the case of 420 arose out of 138 complaint, you may go for quashing.
