Legal Question in Criminal Law in India
A person has taken money from me after issuing a cheque for the amount. the said cheque was sent his bank of which he happens to be the manager for payment. On receipt of the cheque he instructed his staff to endorse " stop payment " as he did not have the money in his account. Please let me know what action is required to be taken.

stop payment is also actionable under sec. 138 of negotiable instruments act and you may send the legal notice to him within one month from the date of stop payment and then file the complaint under the act.
