Legal Question in Criminal Law in India
A person has done overwriting on the cheque and also counter signed it , but it appears to be little different. At the same time , i have enquired from his account , his balance is zero and he has issued the cheque for 1 lac . Now will the cheque get bounced by siganture mismatch or insufficient fund ? in both cases can i file a legal case ?

You may pursue your remedies under Section 138 of NI Act in both the situations after the cheque is bounced and you receive advice from your bank.
