Personal Appearence

In a case against a builder lodged by me in Consumer Forum, the respondent had never turned up for hearings but one of his office employees and a councilor pleaded for him. It happened that one of the documents he signed and submitted in the Forum was of perjuries in nature. This is being taken up by the Forum in a separate case on my application. Since the on coming enquiry is called for by the Forum to ensure without doubt that the contents of the documents had been read out to him by his councilor and he had signed with full knowledge of the implications, can I plead for the personal appearance of the builder?

Why do u want to plead for his personal appearance?

The court is already working in your favour. Many litigations are lost because people get over aggressive.

You can but there should be some solid ground. But you may first check the authority letter of the persons appearing on behalf of builder and their capacity.

normally the proceedings before the consumer court are deemed to be quasi-criminal. so the consumer court do not insist on the personal appearance of the party
