Re: plea bargaining

Sir,

As after the amendments of 2006 in Cr. P.C. Plea Bargaining is included under Indian Laws also.

Further, the key benefit of plea bargaining is that the accused can have a conversation by the judge directly and bargain for the punishment.

Re: plea bargaining

There is no "plea bargaining" in India as in USA.

The benefit for the an accused is that the trial is avoided and he can be sure of the punishment well in advance. The benefit for prosecution is that they do not have to bring evidence to prove their case. thus both the parties are benefitted; ONLY if the accused admits his guilt. If you are innocent, and the prosecution has no evidence against you to secure your conviction, plea bargaining is not beneficial.
