Legal Question in Criminal Law in India

Under Prevention of adulteration act complainant/witness has submitted some documents and has stated oath that they are from from site at internet, although they are not from internet. Application u/sec 340 has been filed by me, reply receieved and the matter is fixed for arguments. Can you suggest some good citation to make court bound to complaint under sec 340 against him.

even in case the documents alleged to be filed after downloading from internet, are not on the net, cannot be a ground to file an application u/s 340 of crpc. your application merits dismissal.
