prevention of corruption act

A minister of state of Orissa is caught red handed by CBI while accepting Bribe in New Delhi. Can the trial take place in Delhi or will the CBI have to handover the case to state police for further investigation?

Offence was committed at Delhi and case will be investigated and tried at Delhi.

It depends on so many factors Normally transfer of such vital case is exception and rule is that matter would be tried in local courts unless special court is setup or is applicable

The offence was committed at Delhi so the trial falls in the jurisdiction of Delhi only.

In criminal case the place where offence was commited is relevant. As offence was commited in Delhi the court has jurisdiction.

since crime was committed at Delhi,hence, Delhi court shall hold the trial as the same falls within its jurisdiction and it has nothing to do with the place of residence of the accused.
