Private complaint

My mother was subjected to domestic violence by my wife and in-laws. My mother gave the complaint but the police have given only an NCR. If she wants to book a private complaint in the court when can she do that? Is there any time limit before which she needs to file the private complaint.

the complaint should be filed at the earliest but when the NCR has been filed by the police, u may move the court of concerned magistrate at the earliest to rebut the report filed. domestic violence is a continuing offence so the time has little importance. u may call upon me for further details...at 9811284735, delhi

Basis principle of any criminal case is to institute the same as soon as offence committed. Delay at times is fatal to the case.

(1) there is no time-limit;

(2) she can send a complaint by registered post to the SHO of the area with a copy to the SP/Commissioner.

She is also entitled to invoke the provisions of DVA by filing appropriate complaint.
