promissory note

I have advanced certain sum of money in good faith to my friend. The documentation include an agreement on Non Judicial stamp paper. The agreement consist of an undertaking to repay, a promissory note, receipt, surity. There is no separately executed promissory note alone but forming part of agreement on Non judicial stamp paper. Two cheques were issued towards repayment. In case of default, can a case be filed for recovery under respective law?

If you had advanced money by cheque, you can base your recovery suit thereon.

You can file a case for recovery and if cheque gets dishonoured u/s 138 of NI act also.
