If you are able to prove that the said cheque was issued only for security and no consideration was passed to that cheque, you may get acquittal. Otherwise, even if the cheque is issued for security you are liable to honour it. If you fail to honour, you will be be punished with imprisonment for a term which may extend to two years or with fine which may extend to twice the amount of the cheque, or with both.

If case under section 138 NI is filed, then the maximum punishment is 2 years or fine or both.
