Legal Question in Criminal Law in India

Q on IPC 403, 408 & 420.

I live in UK. I have a private complaint case pending in India u/S 403, 408 & 420. Currently, the process of evidence before charge is going on. I have sufficient documentary proof reg. my innocence. The Complainant is using the case as pressure tactics. I appear in court twice a year and have a lawyer representing me. I don't wish to attend the case but am worried that a non-bailable warrant may be issued which i want to avoid. How should i proceed with the matter, This is in Thane court ? I am searchifng for a better lawyer...?

see you have the option of taking exemptions only. that too till u are not required . if ur advocate is good he will handle everything

You may get exemption from personal appearance through a lawyer or can appoint an attorney to appear on your behalf in complaint case.you may also request the court to conduct proceeding through video conferencing.

No shortcuts in your case. You can obtain exemption from personal appearence through your advocate if there is no dispute with regard to your identity involved in your case. You must have good lawyer otherwise all your documents are waste. I am not saying your present lawyer is not good. This is for you to judge. You can find a good lawyer even in LawGuru.

A duly instructed lawyer/advocate can conduct the trial even in the absence of an accused. Please read provisions of section 205 and 317 Cr.P.C. with case law for seeking exemption from personal appearance of an accused.
