Legal Question in Criminal Law in India
I have registed an FIR under section 379 for theft of bike. The police has caught the thief redhandedly and sent to judicial remand. What is the procedure to claim the bike?

you have to move an application before the magistrate having jurisdiction over that police station where you registered the FIR. the court will order the SHO to release the Bike on verifying the RC of vehicle and subject to your furnishing a bond (of superdari). This bond means that you would produce the bike as and when required by the court.
