Legal Question in Criminal Law in India

Respected lawyers,

My husband works in US.I filed for maintenance under sec 125.Interim order has been passed in my favor.But my husband is not giving me any maintenance.I filed for execution for recovery of arrear maintenance.In previous date DW has been issued against my husband.Again in today's date he did not pay in spite of DW.Magistrate is saying that my lawyer didnot file for requisite of DW.So he has nothing to do.My lawyer is very junior.She doesn't know what is requisite of DW .

1)What is requisite of DW.?

2)Do i need to sent it to my husband or to ministry of external affair?

Please help me in this matter as my lawyer doesn't know how to do it.

i think it must be NBW. i.e. Non Bailable Warrants or it may be distress warrant. i advice you to get the copy of orders made by the court concerned for the better opinion.

You may write complete details of your husband's status in USA. If you have filed a complaint of curelty / domestic violence in India, you may pursue the same in USA also with the I.C.E. authorities as also the local (USA) police and your husband may be directed to provide you adequate support.
