Legal Question in Criminal Law in India

respected sir/ madam,

i am fighting for a cheque bounce case which was issued in my mothers name. but it has been dishonoured 6 times and is in court now. the amount of 11,50,000 in figures is correct but has been mentioned as " eleven thousand fifty thousand" in words which my mother overlooked while accepting.

what are the chances of us wining the case. your reply is eagerly awaited.

Hello

There is a fare changes of you wining the case. Section 138 of Negotiable Instrument Act has gone considerable change. I can understand that parameters coverning Section 138 is limited to only when the cheque is bounce with a remark funds insufficient, stop payment, etc etc, but here you haven't mention in whos handwriting the words and figures are? If the handwriting is of the same person who issued the cheque then there is a fair changes.
