Legal Question in Criminal Law in India
Respected Sir,
I have filed a case against one accused "A" u/s 138 NI act. The honorable Judge ordered the accused to pay the double the amount of the cheque.
Later he appealed before the higher court, where his appeal was rejected.
Unfortunately he did not have anything except some government contracts & a room in his parental house because his father gives Power of Attorney to the adopted son "B" just before his death not to the accused "A" which is his own son.
Sir, now my question is that :-
1.Whether the adopted son "B" has right over his second father's property.
2.Suppose the accused "A" has no money to pay me. what will be his fate.
3.Which laws fovours me at this point of time.
Sir, please advise me, what should I do next & please give your advise in a detail manner, so that I can understand it.

In case an accused fail to pay the fine or compensation awarded by a criminal court, he will be liable to undergo imprisonment in default awarded by such court.
