Legal Question in Criminal Law in India

Respected Sir,

My friend got married to a girl several years ago in India. He came to US after 1 year but for some reason they didn't get along. My friend did brought her wife to USA. He filed for divorce in US and got divorce also. The girl also have married to another person in USA and settled here.

Girl's father didn't like the divorce petition and as soon as he came to know about it, he filed a FALSE case in the Indian court saying that the boy and the family together tried to murder by sprinkling kerosine oil and burn the girl. Obviously none of this is true. Also girl fought the divorce case in USA and tried to get maximum possible amount from the US court and attorney fees etc.

My friend's family had to go through legal proceedings in India for almost 10 years. Now that case is closed as no evidence was found and also the girl never came to India to testify as the case was false anyway.

My friend's family had asked the court to separate my friend's case from the rest of the family. Now only the case against my friend is pending and he has been declared absconding and there is a non-bailable warrant against him.

My question is the following:

Now that the case against the family is closed, is there a way to get the closure on my friend's case also. My friend is US citizen but would certainly like to go to india once in a while. Is it possible to get the closure on my friend's case based on the fact that the original case with the same murder attempt was filed for all people in the family and the case against the family is closed.

Also it is true that my friend wasn't even present in India on the date mentioned for murder attempt.

Is it possible to get the closure on the case by not going to India by my friend because if he goes to India, the case itself my take a long time.

You seem to have good case for quashing . If the NBW have been issued against your friend then i would suggest that he should not come to India till his matter are solved.

Your friend may consider moving a quashing petition in the high court.

1st. I dont agree with other lawyers. 2ndly I dont belive that you are asking for frnd,a frnd cant have such deep knowledge abt frds case.

this a good fabricatd story. you must call me and can get out from this problem. but nothing is free.
