Legal Question in Criminal Law in India

Respected Sirs,

We have ongoing Civil Suit in Tis Hazari, Delhi against my elder brother . After the date He hit me and my father inside the Court Premises and threatened to Kill us in front of our lawyer . We reported the incident to the police with the written statement but according to them they can give us the security inside the court for next time but no action was taken against him .

Similar act was done few years back . he came to our house and badly hit my father and my younger brother and we given the written complaint against him to local police station but there was no action taken against him .He keep abusing parents and us and keep threatening to kill. We have informed the police but no action has been taken against him till date . I keep travelling as per my job requirement so I am bit worried about my parents . Is there a way we can stop him legally .

Your best bet is to file criminal complaint under section 156(3) read with section 200 of Criminal Procedure Code. The magistrate may direct Police to register FIR and investigate or the magistrate may conduct an inquiry into complaint by first recording your statement in evidence and if satisfied, then summon your brother.
