is revision acceptable in DV ACT

I am victim of DV act.

wife files the petition through courier from abroad and court takes cognizance of the petition through courier and issues summons and also asks me to deposit passport. i had challened this order in session and session judge is not sure if revision is acceptable in this special dv act. please advice

Revision is maintainable against the order of the Magistrate taking cognizance as also impounding of passport.

DV Act is very new and special act. Not much litigation is there as yet. plus you have not mentioned as to which court has taken cognizance. to my mind it would have been better if you have challegened the order before high court u/s. 482 Cr.P.C. Revision in my opinion is not maintainable since i feel the order is interlocutory. You are already having technical support of your counsel so plz stop roaming around and let him deal.

tell him that cognigance taken in section 12 and as per section 28 it is goverened by crpc and so revision can lie.
