Legal Question in Criminal Law in India
sec 294(3) CrPC
In sessions trial if any document not properly come in the case diary or not asking about a document to a proper witnss, it is kept as exhibit x.After that when it is cross-examined by the defence side about that document, that is proprly exhibited. If not cross-examined then that document is not exhibited properly. This is done under section 294(3) of CrPC. But in that section it is not specifically mentioned. It is only written that if a document is not disputed then it is taken in evidence or exhibited. My question is this if it is not specifically mentioned then how after cross-examination a disputed document is exhibited?

When a documents is referred to and shown by defence to a witness, it is presumed that same is considered relevant by defence. As such, same is exibited for the purpose of reading and referring such document in the evidence.
