i had taken several loans from the bank to start a business ..... the business was of online lottery in kolkata ... but in the month of december 2004 the govt of west bengal shut down online lottery for couple of months ... whereby i suffered a huge loss ......... i had to exit out of online lottery business due to huge losses. i am now unable to pay the loans to the bank (the loan was in the nature of personal loan)... the banks have filed cases under sec 138 ni act. at this point of time i do not earn sufficient to pay them .......... please advise a way out where i can defer for quite sometime the payment ...

Since the amount taken on loan is in the mode of personal loan, you are bound to repay, bur you have every right to contest the matter and seek for time to repay.

consult an advicate and contest the case.

try to settle the case in alternative dispute resolution(ADR).

approch in lokadalat.

consult with lawyer with all document ,then enter plea bargaining u/s265b of crpc.

ask them to wait till you start earning or keep pending the cases on one pretext or another
