What is the query?
Re: sec138 of n.i.act
the case will fail as no legal liability arises.
Re: sec138 of n.i.act
You may not be required to prove the loan at the first place; the initial burden is upon drawer of the cheque to show that he did not owe you money and that he had issued the cheque without consideration / liability.
Re: sec138 of n.i.act
Unfortunately, you have a very weak case. Try to settle the matter out of court.
