Sec, 420,465,467,468,471 Rw 120-B
I had a Civil property suit going on in
the Civil Court & my Suit was
dismissed as the court was of the
opinion that instead of filing the suit
for possession I should have filed a
suit for specific performance, which I
did not file as the Title of the seller
was under cloud, The son of the
deceased seller had made an
application before the said civil to
initiate cri,inal proceedings against
me, which was outrightly rejectrd by
the Hon'ble Judge. Now the son of
the deceased seller has filed a private
complaint in the Magistrate Court &
and the said MM has initiated
proceedings under the above
mentioned sections by asking the
police to do so as per Sec 156(3) I
immediately moved the Sessions
Court a procured an Ad-Interim
Anticipatory Bail which was then
rejected by the Court latter, I have
now got the ad-Interim bail from the
High Court and will be heard for
passing the Final orders in a weeks
Time What should I Do? Please
advice

i think earlier when the court had rejected the application of deceased seller, it must have been on technical grounds that the forgery etc. was committed before the suit was filed. you have nearly spoiled your case as you cannot file another suit for specific performance as the same being barred under order 2 rule 2. however, you may file the suit again with an application or leave to file the same again. as far as complaint is concerned, in case you HAVE NOT done any wrong, you may move the High Court for quashing of criminal proceedings.

Since you are already pursuing your remedy in courts, it will be better to follow your lawyer's advice. Moreover, in a pending case, it is not advisable to comment on possible result or the order that may be passed by the court.
