sec 125
I am not satisfied with my present lawyer.i want to change my lawyer for maintenance under sec 125.My lawyer saying that i can't change my lawyer and he will not return me the brief until he writes NO OBJECTION and he is charging Rs 2000/ to write NO OBJECTION.
Is it true that i can't change my lawyer and he is not bound to return the brief to me until he writes NO OBJECTION letter?

You may be liable to make payment of the 'committed' amount for the work already done by your previous lawyer.

No separate fees need to be paid for NOC.

in case there is an agreement of fee and there is some balance fee remaining, you will have to pay the fee for NOC and the lawyer can retain documents for fee as per advocates act.

No objection of previous lawyer is necessary if you are appointing new lawyer without terminating services of previous lawyer as per rules by giving his intimation/notice.
