Section 340 of criminal penal code

A Metropolitan Magistrate court had dismissed my petition on perjury committed during proceeding in a consumer forum. However it advised me to use Sec.340 of Cr.pc and plead consumer forum to request the magistrate court to take action on the respondents for perjury. The case before the Consumer forum is already closed one and half years back. Can I request the forum to reopen the case for this purpose?

An application u/s 340 Cr. P. C. is maintainable only after the proceedings are closed.

Proceedings U/s.340 Cr.P.C. are independent proceeds and can be initiated even after disposal of matter out of which it arises.

Yes sir, all you have to do is to file an application u/s 340 cr pc before the consumer forum and they will register the case as a seperate case and then forward it to the magistrate.
