section 30 of CRPC 1973, INDIA
what is the maximum sentence in default of payment of fine - is it maximum 9 months or one fourth of the maximum of offence, which the court can pass. Suppose, there is sentence 10 years under the section. What would be sentece in default of fine 9 months or two and half years

You should better confine to facts of your case.

1/4 of the sentence and the maximum of 3years. Read the section 30 alongwith Sec 29.

Section 30 does not provide for 9 months sentence in default. However, it does provide that maximum sentence in default can be one-fourth of the substantive sentence.
