Section 138 0f N.I Act clarification requested
A case filed u/s 138 of NI Act during 2003. In june 2006 it was sent to Lok Adlath.Both parties agreed settlement of 1,20000 rupees.For the past three years accuse paid only Rs.70000/.The accused did not appear in the court.I was teased like anything for that payment.I filed a vexation pettison to send back to the trial court. Now it is with the trial court.In this connection it is my contention that the accused having paid more than 50% of the cheque amount ,he admitted the issuance 0f the cheque for the legally enforcible debt. So the court has to deliver judgrment.Request your esteemed clarification

Pursue you case in the trial court.

Judgment can be delivered only after completing formalities like recording of evidence, statement of accused U/s.313 etc.
