section 138 ni act

the citibank has filed 2 cheque bounce case against me in chandigarh.actually,the dma of citibank manipulated and changed the tenure of the maruti car loan from 5 years to 3 years.also,now the complainant is relying on date of release of car as 16-01-2002,but i got new car on 26-12-2001 i.e.the date of first agreement..i had insurance cover and sale letter of 26-12-2001..i am relying on car loan agreement as dt.26-12-2001,but citibank is relying on 16-01-2002.despite numerous opportunities given.the complainant could not produce original agreement in the court.in another case,i had prayed for mandatory injunction for staying misuse of the cheques.

now,the position is that citibank is agreeing on cheque amount only and not on the entire loan.

my counsel adviced me to give statement u/s 313 as these cheques are BLANK SECURITY CHEQUES and these will not come under financial debt liability.the citibank closed evidence without producing any other witness and original loan agreement.please advice me.the citibank has forged and fabricated the loan agreement and thus not producing the original one.thanks.
