Legal Question in Criminal Law in India
A is an Senior Incharge Officer of a Govt Office. B is working as a junior Clerk in the same Office. A has forced B to follow instructions which are illegal and not reasonable as per rules. B denied to do so. A became angry and created some wrong entries in leave register of B. Then he had reported incorrect informations about B to head office. A had also issued a show cause letter upon B and asked for reply.
In the present case B is innocent. A tried to fix B in to departmental enquiry proceedings. A could not suceeded.
Can B file a criminal case against A in court ?
In the present case A & B are falling under the Public Servant Category.
