sir if any accused is absconded and proclaimation order is to issue against him u/s. 82 or 83 cr. p. c. then court suo moto issues such order or lawyer has to make applicatopn to court to issue sucj order...
1. is it binding on court to issue such order u/s. 82 or 83
2. can defence lawyer make such application for issuing proclaimation order

It could be either ways,but let me correct you that the defence lawyer has nothing to do with it. Only the prosecution or the complainant lawyer have to file an that application, if need be..
