Legal Question in Criminal Law in India

sir

If a cheque is drawn on a bank in Himachal & it is presented for payment in New Delhi branch but got bounced.Plz let me know whether we can file a criminal case in New Delhi or in Himachal.

A cheque bounce complaint can be filed anywhere and not necessarily where the transaction took place, ruled the Bombay high court in IDEB Projects Pvt. Ltd and L&T Finance Limited on 24.1.08

You may file at both places.

If there are any peculiar facts and circumstances of your case like you and accused both live in Himachal and you presented the cheque at Delhi only to harass the accused etc. then it is advisable to file case at a place where all transactions happened.
