Legal Question in Criminal Law in India
sir,
interim order for maintenance under sec 125 was passed in my favor.I got married under HMA.I again went to US where my husband works in temporary visa.I stayed at his flat which is rented.But after i went and reached his flat in US he moved out and started living in some other place.But he took the flat in rent for his own use.But just because i stayed at his rented apartment and he stayed at some other place he is asking indian court to exclude that rent amount from my maintenance due.But on the other side he is getting income tax exempt in US by showing me as his dependent.Can court court exclude rent amount from my maintenance?

In your earlier application did you cover the averment about the rent in usa being paid by Husband? Does the order on maintenance covers any finding on the component of rent? Depending upon the facts, you may move an application before the court to revise the maintainence under the new facts.
