Legal Question in Criminal Law in India
Sir, jb chrge pe rguement ho rhi ho to iss baat ka benifit liya ja sakta hai ki beyond reasonable doubt kuch bhi nahi hai main yeh offence kyon commit karunga mere khilaaf koi direct evidence bhi nahi hai, therefore aquit me..... at this stage without begining trial.

your lawyer can argue on charge and in case no offence is made out, you may be discharged. in case you still charged with the alleged offence, you may go for quashing.

There is a provision of discharge in CRPC. You can ask you lawyer to file a application in Court for discharge. if there is no evidence, then you will be discharge, and will not have to go for trial
